PARTNER VISA

(SUBCLASS 300, 820/801, 309/100)

Feature:

Hope to join your partner who are Australian citizen, Australian permanent residents or eligible New Zealand citizens and live in Australia? If you are in Australia, you can apply the Partner visa (subclass 820/801). If you are overseas, you can apply for the Partner visa (subclass 309/100). The 820 and 309 visas are temporary visas, allowing you to stay in Australia while the permanent visas (801 and 100) are processed. The Prospective Marriage visa (subclass 300) is also available for joining your prospective spouse.

With the Partner visa (subclass 820/801, subclass 309/100) you can:

  • live, work and study in Australia (indefinitely for subclass 801 and 100)

  • travel to and from Australia

  • enroll in Australia’s public health care scheme, Medicare

  • if eligible, become an Australian citizen (for subclass 801 and 100)

 

With the Prospective Marriage visa (subclass 300) you can:

  • live, work and study in Australia for up to 9 months

  • travel to and from Australia

 

Eligibility:

To apply for the temporary partner visas, you need to meet the following requirements:

  • Be the spouse or de facto partner of an Australian citizen, Australian permanent resident or eligible New Zealand citizen

  • Have a sponsor (usually your partner)

  • Be at least 18 years old

  • Other requirements

 

To apply for the permanent partner visas, you need to meet the following requirements:

  • Hold a temporary Partner visa or Dependent Child (subclass 445) visa

  • Be in a relationship with your spouse/de facto partner declared for temporary Partner visas

  • Continue to be sponsored

  • Other requirements

If your relationship breaks down under certain situations, you might still be eligible for the permanent visa.​

 

To apply for the Prospective Marriage visa, you need to meet the following requirements:

  • Be sponsored by your prospective spouse

  • Be at least 18 years old

  • Other requirements
